Having applied themselves for Planning Permission from Bury Metropolitan Council to develop their front garden, our client then received a refusal notice from the council. The reasons for refusal related to the impact of the development on the openness of the Green Belt which was deemed contrary to both national and local planning policy.
Following the refusal, the client got in touch with us to discuss their options. We have worked on many Green Belt applications and are very familiar with development rules. Having assessed the proposals it became apparent to us although the application was within a Green Belt area, the development did not constitute inappropriate development in Green Belt . We immediately started working on an preparing an appeal for our client.
The main thrust of the appeal was that the proposals did not impact on the openness of the Green Belt and therefore they did not constitute inappropriate development that was contrary to planning policies. The site was well screened along the road frontage by a mature hedgerow which reduced the visual impact further. It was also the case that the proposals would result in an improvement to highway safety by allowing vehicles to access and egress the site at the same time.
A few months after the submission of the appeal, a planning inspector visited the site to assess the situation for themselves in light of the submission from ourselves and the Bury Council. The inspector subsequently concluded in their decision letter that the appeal should be Allowed as she concurred with the arguments put forward by ourselves on behalf of the client as why the proposals did not breach national and local planning policies relating to the Green Belt.
