The client had purchased a property with a one-bedroom annex on site in the form of an outbuilding. The previous owner of the property had converted and extended a single-story outbuilding into living accommodation consisting of a double bedroom, large living room, kitchenette, bathroom, private garden and parking space with its own postal address. A family member of the previous owner had lived in the annex; however, the client’s intention was to rent the property out separately from the main residence.
It came to light the property that the annex had never had planning permission approved by Bury Council to be used as living accommodation. The Council then required the client to make an application to seek Retrospective Planning Permission.
The client got in touch with MPD to discuss the issues and their options with one of our consultants. During the process, our MPD Consultant Mike evaluated the likelihood of planning permission being granted having regard to the ability of the unit to operate as a separate independent dwelling. Mike then identified the dwelling’s adherence to relevant national and local planning policies. Consideration was also given to non-compliance issues and how these could be overcome to satisfy the LPA. After pulling this information together, a detailed application was made to Bury Council seeking Retrospective Planning Permission.
Upon submission of the application, we entered into detailed discussions with the Planners to agree solutions to all their concerns in relation to the use of the annex as a separate unit of accommodation, Having managed to satisfy all the requirements of the Planning Officer, Bury Council subsequently granted Retrospective Planning Permission. With this success the client was free to pursue their desire to rent the dwelling out with the knowledge that the necessary consent was in place.
